DMCA Copyright Policy
Shapparels respects intellectual property rights and asks every visitor to do the same.
1. Our Commitment
We list only designs that we created or are permitted to use. Where you think a listing or other material on shapparels.com infringes a copyright you own, send a notice as described below. Notices are processed in line with 17 U.S.C. § 512, the Digital Millennium Copyright Act.
2. How to File a Notice
A valid notice is written and contains: (a) a physical or electronic signature of the copyright owner or of a person authorized to act for them; (b) a description of the copyrighted work you say is infringed; (c) the URL of each page that shows the material in question; (d) your name, postal address, telephone number and email address; (e) a statement that you believe in good faith that the copyright owner, its agent or the law has not permitted the use; and (f) a statement that the notice is accurate and, under penalty of perjury, that you own the copyright or are authorized to act on the owner’s behalf.
3. Our Designated Agent
Address notices to: Shapparels — Attn: Copyright Agent, 1554 Lorewood Grove Rd, Middletown, DE 19709, United States. Email: [email protected]. Use “DMCA Notice” as the subject.
4. What Happens Next
A complete notice is reviewed within 5 business days. Material that appears to infringe is removed or disabled, and where another party supplied it, that party is informed.
5. Counter-Notification
Material removed in error can be restored through a counter-notice. The counter-notice must contain your signature; a description of the material and the location where it appeared before removal; and a statement, under penalty of perjury, that you believe in good faith the material was disabled as a result of mistake or misidentification. Also give your full name, postal address and telephone number, and state that you accept the authority of the U.S. federal district court covering your address (or, for an address outside the United States, the U.S. District Court for the District of Delaware).
6. Repeat Infringers
Where a party is found to infringe repeatedly, we remove the content and terminate our relationship with that party.
7. Misrepresentation
Under 17 U.S.C. § 512(f), a person who knowingly and materially misrepresents that material infringes, or that it was taken down by mistake, can be held liable for damages.
